Auction Types

There are several types of auctions you can submit your goods to on Bmobm Auctions, They are as follows:

The Standard Auction
A Standard Auction is free for a basic listing with up to 4 picture. Only final price fees apply if a sale is successful. These auctions run over a time period set by the seller. The clock counts down and the member who has placed the highest bid when the time runs out wins the item.

Instant Purchase Auction.
With Instant Purchase Auctions items are listed for sale over a time period set by the
seller. A fixed price is set on the auction and a buyer can instantly agree to pay the fixed
price. This ends the auction and speeds up the buying/selling process.

Combination Auction.
The Combination Auction is both the Standard Auction and the Instant Purchase Auction combined. This means that there is a low start price but also an instant purchase option at a higher price should the buyer wish to buy the item early.

Dutch auctions
On a Dutch Auction, the auctioneer has more items of the same product for sale. The bidder will enter a maximum bid he is willing to pay for an item, and the number of items he wants to purchase. The highest bidder(s) will receive the number of items they have bid on, and the remaining bidders will receive the number of items still available. Buyers are able to bid more than once for the same item.

proxy bid
Just as in offline auctions you can place a bid that is higher than the next increment. Bmobm Auctions then bid's for you. The auction will continually bid for you up to your set bid ceiling. This ensures that you pay the lowest possible price available.
Example.
An item is £5 and the next increment is £5.50. You bid £7 but the auction shows you as high bidder at £5.50. Somebody else then bids £6 , because you have a book bid in with a ceiling of £7 the auction automatically increases your bid to £6.50 which is the next bid increment above the nearest 2nd place bid. This continues until your limit is reached where you would need to bid again if you wish.

Wanted Auction.
This allows a member to place a free advert for an item required, the process is simple and quick. Sellers can then place free offers against that auction. If the seller is successful they pay a small commission.
The offers made are exclusive to the buyer who placed the wanted advert and any number of offers may be made. All members can see these offers as they will show up in wanted offers search. The exclusivity time ends when either the offer period reaches an end or the buyer chooses to buy the item offered.

Feedback policy

Our feedback system allows all Bmobm Auctions members to leave a report about other members that they have transacted with. Feedback can only be left by and for members that have been involved in a completed transaction.

This is an important feature of Bmobm Auctions as it allows other members to view a user's previous form. This shows as a score alongside your/their username.

In order to ensure that one member can not falsely or maliciously increase or decrease another members feedback the scores given are by individual unique members only.

Example. You may have purchased 5 items from a seller. You can leave 5 feedbacks and all five feedback reports will show in their member history. However if for example the feedbacks were positive they don't count as 5 points they will only count as 1 point. If you purchase an item from the same member at a later date, the same rule applies that you can leave a report but no points will be added to the members feedback score.

The scoring system is simple.

A positive feedback rates as +1 point
An average feedback rates as 0 points
A negative feedback rates as -1 point

Once feedback has been left it cannot be removed unless it contains the following:

Personal contact details
Defamatory content.
Libelous content.
Feedback left by a person who has since been removed from the membership due to incorrect contact information.
Feedback containing external links.
Feedback that contains vulgar or racist comments or words.

Please use the contact us form or the Abuse report form found in the members area to report a feedback that may meet this criteria and we will review the feedback in question.

We also have the facility for a member to reply to a feedback. This is shown below the relevant feedback entry.

Guidelines.

Please ensure that you leave feedback for all transactions that you are involved with. This will help the community in the future.
Do not leave feedback that could be seen to be vulgar, racist, libelous or defamatory.
Make good use of the feedback system to decide on the trustworthiness of a member.
Please ensure that every possible avenue has been explored before leaving a negative feedback. See Feedback rules

General Behaviour on Bmobm Auctions

Bmobm Auctions is built around a network of buyers and sellers on an easily accessable website. Access will be available to a wide variety of people, types, faiths and cultures, more importantly all age groups. It is because of this great mix that the management insist on respect for all by all. We therefore insist that all descriptions, e-mails, forum entries, etc, contain no vulgarities, racism or profanities.

THIS POLICY WILL BE STRICTLY ENFORCED.

It is part of our user agreement that listings conform to the rules and do not contain prohibited items or unacceptable images. Members are expected to maintain this strict standard, and any member who finds any text and/or images of offensive nature are asked to report to us using our Abuse report form found within your members area.

Problems? Yes, sometimes things can go wrong. Parcels get delayed or lost. Items get damaged in transit. Buyers make a bid in error and more. Remember, all of the Bmobm Auctions members are just ordinary people trying to deal with every aspect of the transaction, from listing to final packing and posting. We therefore ask all our members to be understanding and endeavour to rectify problems in a proper, democratic manner.

Bmobm Auctions and our members have a fantastic oppurtunity to create a happy, prosperous community. Let’s ensure we all achieve this goal.

Selling

Direct sales.

It is against our rules for a seller to ask a buyer to trade outside of the Bmobm Auctions website on a listed item. All pre sale email traffic is shown on the listing page and any solicitation for direct sales can be investigated and policed in this way. Members found to be soliciting direct sales will receive an official warning which may lead to their removal from the website and any outstanding fees charged to their account.

Price setting.

VAT registered members.
All prices must include VAT at the sellers local current rate.

When setting the starting price the seller must price the item at a price that they are prepared to sell the item at in the event of a successful sale. The only exception to this is where a reserve price is used. When a reserve price is set by the seller the bidding must be equal or higher than that price for the transaction to be binding. If an auction does not reach the sellers reserve price there is no commitment for either party to complete the transaction. We do charge a fee for the use of reserve prices. See fees.

The seller has the option to include or exclude postage costs within the price. If postage fees are excluded the seller must state this within the description and enter postage costs, if known, into the postage section when creating the listing. It is against our rules to offer items with inflated postage prices in order to reduce the item selling price. This is seen as circumventing Bmobm Auctions fees.

Correct categorization.

It is important that your listing is put into the correct category. This will help items to be found by potential buyers.

There are many categories throughout Bmobm Auctions, but there is always room for more, so if you think of a category which we havent already got but you would like to see it. Please use the suggest a category link in your members area.

Listings placed in the wrong category may be ended early. In this instance an email will be sent to the seller stating that the listing is incorrectly categorised and any listing upgrade fees charged by Bmobm Auctions will be credited to the sellers account. The seller can then choose to re-list the item in the correct category.

Comprehensive descriptions

It is important for sellers to include as much information in the listings as possible. This will greatly improve their chances of selling an item. It also means that they will have fewer questions to answer from potential buyers.

Give a full description of the item.

Ensure that your accepted payment terms are represented and correct.

Give a true indication of postal costs.

True descriptions.

When describing an item ensure that you do not misrepresent the listing by ensuring you provide an accurate and complete description. If an item has some marks or damage please indicate this within the description and if possible show images of the area. Take particular care when selling factory or store returns or faulty items to clearly state this.

By doing this you are being fair to the buying member and this will avoid disappointment and dispute issues.

Only sell items that you physically have in your possession.

It is wise to only sell goods that you physically have in your possession. It is often tempting to start an auction for an item that is due to arrive with you before the auction ends. However, if for some reason that item is delayed it can have a knock on effect that might delay you supplying your new buyer, thus causing unnecessary complaints.

Bidding on your own auction.

Bidding on your own item is not allowed. Asking a friend to bid on your own item is also not allowed. Bmobm Auctions will not accept bids placed on an item that comes from the same computer that the item was listed from. This is an important rule and our investigation team will investigate any activity that points towards this happening. Members may have their membership cancelled if this activity is found to take place.

How does Bmobm Auctions police illegal bidding patterns?

Bmobm has a superior software programme which is constantly investigating and searching for bidding patterns that lead to falsifying prices on listed items. Geographical location of members, repeat exclusive bidding patterns, and many other pieces of information are studied to ascertain if any illegal bidding procedures are taking place. It must also be understood that one member may simply be a regular buyer from another or equally live close by . These are the things that we will take into consideration when reviewing a case.

More than one account on Bmobm Auctions.

It is accepted that a member may wish to have more than one account, but any transaction, bidding or feedback activity between the accounts is not allowed. We will investigate any reported activity between these types of accounts. Sellers found to be bidding on their own auctions will receive an official warning which may lead to their removal from the website and any outstanding fees charged to their account.

Members may wish to have more than one account for a number of reasons. For example they may wish to separate different parts of their Bmobm Auctions business. One account for buying and one for selling. Maybe an account for business use and one for private use etc.

Completing the transaction.

Just as a buyer is committed to paying for an item when a bid has been successful, a seller is then committed to supply the goods offered to the successful bidder. Once cleared payment has been received by the seller, the seller must ensure that the goods are sent to or collected by the buyer. Failure to do this may lead to an official warning.

Distance Selling

Distance selling regulations apply to a person in the course of selling an item for a business to a consumer. This applies in an internet sales environment as the transaction is not in person , or face to face. It is therefore classified as (distance selling). These rules apply to the business supplier who must provide clear information about themselves and allow a cooling off period.

To learn more about this subject follow the link below.

http://www.dti.gov.uk/consumers/fact-sheets/page24635.html

If in doubt it is advisable to take local independent legal advice , or consult your local trading standards officer.

Buying

Registration information.

In order to ensure a safe trading environment all Bmobm Auctions members must ensure that their personal contact information is up to date at all times. This includes current address, phone number, email address and other details. If false information is found on a members account the membership details will be removed from the website immediately and all outstanding account fees charged to their account. All personal contact details can be administered via your Members area.

Bidding.

Buying members must be fully aware that if a bid is successful then a binding contract between the buying and selling members exists.

A bid is deemed successful in the following circumstances.

Standard auction (without reserve).
The member has the highest bid at the end of the auction time.

Standard auction (with reserve).
The member has the highest bid at the end of the auction time providing the bid is over the reserve price. In the event that the highest bid is less than the reserve price there is no commitment to complete the transaction by either party. It is clearly marked on each auction page when a reserve price, if used, has been met.

Instant purchase auction.
The member bids the instant purchase price as advertised by the seller.

Wanted auction offer.
The buying member accepts the selling price offered by the selling member.

Members who break this “binding contract” rule will be issued with an official warning and may be removed from the website without warning and refused further access.

Retracting a bid.

In order to avoid a bid retraction we remind our members to:

a, Ensure funds are available to complete the purchase.

b, Ensure the selling member accepts a payment type that matches the buyers payment type.

c, Ensure the bid is correct.

d, Ensure all delivery, or collection options are fully understood. Postage or courier costs are allowed for, and maximum weights for courier delivery (one person) are not exceeded (Health and safety at work)

If you follow these guidelines you should never need to retract a bid. However in the event of a mistake being made we have a procedure which must be followed.

both the bidder and the seller must agree that the bid was a mistake and then both the bidder and the seller must submit individual correspondance to wrongbid@bmobm.co.uk The Site administration will then have to cancel the bid. Please be aware that if the submission for a bid retraction is late there is a possibility that the retraction cannot take place and thefore both buyer and seller must come to an agreement between themselves. Frequent misuse of this facility may lead to cancellation of membership .

IMPORTANT.
Read the description thoroughly – then read it again!

Only bid if the item matches your requirements. Think before you bid..

Do not bid on an item that is specified as collection only and expect it to be delivered.

Do not bid on an item for which you do not have a matching payment type.

Do not bid on an item if a seller has specified particular requirements, for example a seller may ask that bidders with a negative feedback rating must not bid.

Do not bid on an item using a third party or other Bmobm Auctions account if a seller has blocked your original account.

Payments.

When your bid is successful you are then committed to pay for the item and associated costs (postage etc...). As a guide 7 days is an accepted period for the payment to arrive with the seller. See unpaid item process. Bmobm Auctions treat unpaid items very seriously as this undermines the trust within the community. Repeat offenders will be removed from the website and any outstanding fees charged to their account.

Direct sales.

It is against our rules for a buyer to ask a seller to sell outside of the Bmobm Auction website. All pre sale email traffic is shown on the listing page and any solicitation for direct sales can be investigated and policed. Members found to be soliciting direct sales will receive an official warning which may lead to their removal from the website and any outstanding fees charged to their account.

Negative Feedback Rating.

A negative feedback rating is when a members feedback score is less than 0 . eg -1 . This occurs when a member has received more negative scoring feedbacks than positive. Sellers are often careful not to accept bids from members with a negative feedback rating and can block named members by using their block members facility. Do not bid on an item using a third party or other Bmobm Auctions account because a seller has blocked your original account.

Reserve Price

Reserve prices can be set at any level, even below £50.

When a reserve price is stipulated by the seller the message "Reserve not met" appears below the current price on the auction page. As the reserve price is known only to the seller, buyers will need to increase their bid in order to attempt to pass the reserve price. Once a bid has been placed over the reserve price, the Bmobm Auctions bidding system accepts the bid and will update the current highest bid price to the reserve price. See below for an example.

If a reserve price is not met by the end of an auction the transaction is void and no commitment is made by either party.

Example.

An item shows a current price of £5.00 "Reserve not met". Unkown to you the reserve price is set at £20. The next bid must be £5.50. You bid £25 and the current price changes to £20. This means that you have passed the reserve price. The "Reserve not met" message disappears and you are the current high bidder.

Bid Retractions

You can only retract your bid under the following circumstances:

1. You have entered the wrong bid amount. You can only correct this within 30 minutes of placing the original bid and retractions are not allowed in the final 30 minutes of an auction.

2. The seller has revised the auction since you placed your bid. This must be done before the last 30 minutes of the auction.

If for any other reason you need to cancel a bid, you must contact the seller direct.

Please note: Bmobm monitors and records all cancelled bids in an effort to eliminate abuse of this facility.

Forum Rules

We have included a forum rules section here as a forum will be intergrated very soon into this website. Please come back and check the rules once we have informed you of the intergration.

Password Advice

Your Bmobm account is protected by our server security systems and your password.

Your passwords are the keys to your internet life

Don’t make it easy for hackers to guess your password. Use strong passwords and keep the bad guys out.

Bmobm will never ask you for your password or login details in any correspondance.

Risks

  • The best security in the world is useless if a malicious person has a legitimate user name and password. They can do everything you can do.

  • Some people’s passwords are just easy to guess, like “password”.
  • Others use plain words that can be guessed by a hacker’s program that tries every word in the dictionary.

  • If you use the same password for every site, a hacker only has to break it once to have access to everything.
Should we require you to update your account we will suggest that you do so by entering the site in the normal way and going to the specified location.

    use strong passwords

    A good password:

    • Needn’t be a word at all. It can be a combination of letters, numbers and keyboard symbols.
    • Is at least seven characters long. Longer passwords are harder to guess or break.
    • Does not contain your user name, real name, or company name.
    • Contains a mix of upper and lower case letters, numbers and keyboard symbols (i.e. ` ~ ! @ # $ % ^ & * ( ) _ + - = { } | [ ] : " ; ' < > ? , . /).
    • However, be aware that some of these punctuation marks may be difficult to enter on foreign keyboards if you are travelling.
    • Is changed regularly.

    • Don’t use weak passwords

      Avoid weak passwords. This means:

      • Using no password at all.
      • Using a commonplace dictionary word.
      • Something that is easy to work out with a little background knowledge. For example: favourite football team, birthday, spouse's name etc.
      • The most common password is ‘Password’ so that’s an obvious one to avoid.

A password you haven’t changed in more than a couple of months.

Look after your passwords

  • Never disclose your passwords to anyone else.
  • Don't enter your password when others can see what you are typing.
  • Use different passwords for different services. In particular have a unique password for banking sites.
  • Change passwords regularly.
  • Don’t recycle passwords (e.g. password2, password3).
  • Don’t write passwords down. Instead, use memory tricks to remember them. For example, make a password out of the first letters of each word in a memorable phrase or substitute numbers for letters (for example: 5 for s, 3 for e).
  • Don’t send your password by email. No reputable firm will ask you to do this.

If you think that someone else knows your password, change it immediately.

If you receive an email claiming to be from Bmobm.co.uk asking for you to confirm your details by following a link in that email it will be a spoof email as Bmobm will NEVER ask you to do this. The only time Bmobm send links in emails will be when relating to a particular auction that you are either involved in or watching. Bmobm will also send email links for questions asked on auction pages. Every email sent from a Bmobm site will include your user name and full name. If these are not present at the top of your email, it is not from one of our websites.

Unusual Item Approval

There may be occasions when a seller has an item they wish to sell but are not certain if it contravenes any of the Bmobm rules. Sometimes items can fall into grey areas within the rules and guidelines. If you have such an item please contact us on support@bmobm.co.uk or use the contact us page with a description of your proposed auction. We will then make a decision if the item is allowed to be listed. If an item is approved we may also send back to you an approval message to add into the top of your description. This will have an official approval number and when displayed will look like this:

Unusual listing: This item has been approved by Bmobm to be listed Approval code WAC199
Bmobm then records this approval and constantly monitors all live approved listings. If a user attempts to copy or make up a mock approval message it will lead to instant suspension of their Bmobm account.

Inland Revenue & Self Employment

If you are selling on one of the Bmobm auction sites with a view to making a profit, you are in effect generating an income. We therefore advise you to study the information given in the Inland Revenue pages.

To view these pages please go to

http://www.hmrc.gov.uk/selfemployed

If in doubt it is advisable to take local independent advice.

VAT

VAT is included at the current UK rate in all of the Bmobm fees.

Item Watching

The item watch features lets you keep a close eye on any auction without having to place a bid on it. This feature means you can be kept up to date on how an auction is doing and prepares you to place a winning last minute bid. You can watch any auction by clicking on the Watch this item link on any auction page.

After Auction Guide

Here are a few guidelines of how to ensure your transaction goes smoothly after the sale.

As soon as an auction is completed within Bmobm an email is sent to both parties to confirm the sale. Both sides then need to contact each other as soon as possible. Initially its best to do this by email although in a bid to reduce missuse of the site we supply users phone numbers in the end of auction emails. Remember sometimes buyers and sellers can be away from their computer for a while or they can experience computer or internet connection problems.

So the rule of thumb here is to be patient.

Ensure that you confirm all prices and details. These will be in your confirmation email from Bmobm.

Sometimes emails bounce back. This sometimes happens due to the other member possibly having a problem with their ISP server or they may have reach their mailbox quota. If this happens try sending your email again or as a last resort use the telephone number provided in the end of auction email.

Arrange the payment direct with each other.

Post the item.

Leave feedback

If the buyer doesn't pay for the item you can follow our Unpaid Item Procedure.

If the seller doesn't ship the goods. Bmobm Auction sites are simply the venue and can't offer protection in a person to person transaction. Therefore it is always prudent to check a members feedback before bidding on an item. Using credit card services can increase your protection if an item is not received or is not as advertised. The rule here is to be as vigilant as you always would anywhere else. For instance, posting cash in an envelope is not recommended as you have no recourse or proof

Bulk Lister

To be Completed

Non paying bidder

When a buyer and seller complete a transaction it is a legally binding contract between the two parties and the buyer is required to pay for the goods. In the event that a transaction is not completed the seller can make a claim for the final price fee to be refunded to their account. Item upgrades such as “home page features, extra photos” etc are not refundable.

The first step in the process is to ensure that you have attempted to complete the transaction fully.

You must also send a payment reminder by using the button alongside the advert on your "Control Panel - Payment Reminder" page. Once this has been done please allow 7 days for the buyer to respond. Once this time has lapsed you may proceed with the unpaid item process using the Claim back end of auction fee link, a claim back request will be sent to the site administrator, and will be evaluated for fee refunding.

Once submitted Bmobm Investigation team will email the buyer and ask them to confirm what you have said is true.

You will be informed by email if the buyer responds to your dispute.

In the event of both the buyer and seller agreeing to a mutual cancellation of the transaction the fee can be refunded and no further action will be taken by Bmobm.

Once the buyer has received a dispute email from us they can follow the link on the email to go to the dispute resolution page and can then choose one of the options to solve the problem.

The seller then receives an email asking if this is acceptable and can choose to close the dispute.

If the buyer does not pay or does not respond to this email within 7 days the final price fee refund can be claimed by the seller and the buyer will receive an official warning. This may lead to the buyer being suspended if this situation reoccurs. An official warning is a serious offence and is only applied to a members history in situations like this where a member has been negligent of meeting their responsibilities.
To claim a refund use the Claim back end of auction fee link, a claim back request will be sent to the site administrator, and will be evaluated for fee refunding.
A refund will only be given in the event of the buyer not responding or a mutual agreement being met by both parties to dissolve the transaction.
Disputes and final price claims must be made within 31 days of the auction ending.

Auction Watch

The auction watch features notifies you of newly listed auctions which contain keywords you have chosen. For example if you are looking for a Playstation 2 you could enter in those keywords from within your members area. Each time a new auction is listed containing the term Playstation 2 you will be notified via email notification from this web-site. You can enter in as many keywords as you like.

If you purchase less than there are available in total, the auction will remain open with the number of items left available after you have purchased the amount you want.
